Terms of Service

Welcome to Gingerbread™. By creating an account or using the Gingerbread mobile application (the "App"), operated by Gingerbread Studios LLC, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. Minimum Age

You must be at least 13 years old to create an account and use Gingerbread. By registering, you confirm that you meet this age requirement.

2. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials.
  • Each person should create only one account. Shared accounts are not supported.
  • You are responsible for all activity that occurs under your account.
  • Please notify us immediately at hello@thegingerbreadapp.com if you suspect unauthorized access to your account.

3. Content Policy

You agree not to use Gingerbread to create, upload, or share content that:

  • Contains hate speech, harassment, or threats of violence
  • Is illegal or promotes illegal activity
  • Exploits, harms, or endangers minors
  • Contains sexually explicit material not related to personal storytelling
  • Infringes on the intellectual property rights of others
  • Contains malware, spam, or deceptive content

We reserve the right to remove content that violates these guidelines and may suspend or terminate accounts of repeat offenders.

4. User-Generated Content

You retain full ownership of the stories, recordings, photos, and other content you create using Gingerbread ("Your Content").

By using the App, you grant Gingerbread a limited, non-exclusive license to store, process, display, and transmit Your Content solely for the purpose of providing the App's services to you, your designated family members, and the people you choose to share content with. This license ends when you delete your content or account.

You control who you share with. When you export a story or book (for example as a PDF) and send it to someone, that copy is outside our systems and under your and your recipients' control. You are responsible for having the right to share the content you share.

5. AI-Generated Content

Gingerbread uses artificial intelligence to polish story narratives, generate illustrations, and assist you in building stories through conversational prompts (via Ginger, our story assistant). Please note:

  • AI-generated content is provided as a creative aid and may not be perfectly accurate.
  • You are responsible for reviewing AI-polished stories before publishing or sharing them.
  • Gingerbread does not guarantee the factual accuracy of AI-generated or AI-enhanced content.

6. Subscriptions, Purchases & Gumdrops

Gingerbread offers a free tier and paid subscription tiers (currently Storyteller and Chronicle). Subscriptions and other in-app purchases are processed by Apple through your App Store account; we never see or store your payment card details.

  • Auto-renewal. Paid subscriptions renew automatically each billing period unless you cancel at least 24 hours before the current period ends. You can manage or cancel your subscription at any time in your App Store account settings; canceling stops future renewals but does not refund the current period.
  • Gumdrops. Creating stories and illustrations spends in-app credits called gumdrops. Each tier includes a monthly gumdrop allowance that resets at the start of each billing period — unused allowance does not carry over. Gumdrops purchased separately (gumdrop packs) remain in your account until spent.
  • Gifts. Where available, you can purchase a gumdrop pack as a gift for a family member; gifted gumdrops are credited directly to the recipient's account and are subject to these same terms.
  • No cash value. Gumdrops are not money, have no cash value, and cannot be redeemed or exchanged outside the App. Gumdrop balances cannot be transferred between accounts, and unspent gumdrops are forfeited when the account holding them is deleted.
  • Refunds. Purchases are refundable only as provided by Apple's App Store terms or required by applicable law; refund requests are handled through Apple.
  • Changes. We may change subscription prices, tier benefits, gumdrop allowances, or the gumdrop cost of features. Changes to your subscription price or monthly allowance take effect no earlier than your next billing period, and we will provide notice of material changes as required by law.

7. Intellectual Property

The Gingerbread App, including its design, branding, code, and documentation, is the intellectual property of Gingerbread and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Limitation of Liability

To the maximum extent permitted by law, Gingerbread Studios LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

  • Loss of data, stories, or recordings
  • Service interruptions or downtime
  • Errors in AI-generated content
  • Unauthorized access to your account

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

9. Termination

You may delete your account at any time from the App's Settings screen. Account deletion is immediate and permanent.

We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. We will make reasonable efforts to notify you before or at the time of termination.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in the State of Wyoming.
